These Terms of Use (“Terms”) are an agreement between you and PivotNet Technology Co., Ltd. (“we”, “us”) governing your use of the IQ Rise app (the “App”). By downloading or using the App, you agree to these Terms. If you do not agree, please do not use the App.
You may use the App only in accordance with these Terms and applicable law. If you are a minor in your place of residence, you should use the App only with the involvement of a parent or guardian.
The App offers brain-training mini-games (such as memory matching, sequence recall, one-stroke drawing, and number recall) plus three optional entertainment activities: Focus & Action Style, Planning & Adaptability Style, and Growing-Up Interaction Memories. The games and activities can be used offline; some features (such as attribution/analytics and purchases) require an internet connection.
Focus & Action Style, Planning & Adaptability Style, and Growing-Up Interaction Memories generate neutral style and memory summaries from your choices. They are optional activities for entertainment and self-observation. Results have no standardized score or cutoff and should be understood only in that entertainment context.
We grant you a limited, personal, non-exclusive, non-transferable, revocable license to use the App for your own non-commercial purposes. You agree not to:
The App offers optional auto-renewable subscriptions and a one-time, non-consumable lifetime purchase that unlock premium features. All purchases are sold through Apple’s In-App Purchase (IAP). The price, billing period, and any free-trial terms are shown on the purchase screen before you purchase.
The App currently contains no third-party advertising. Purchases are also governed by the rules of the app store from which you obtained the App.
Your scores, progress, and settings are stored locally on your device and can be erased via Profile → Clear All Data. For attribution and analytics, the App uses third-party SDKs (Adjust and Xuanhu / FunReport) that transmit a limited set of device identifiers and usage data. The advertising identifier (IDFA) is used only after your App Tracking Transparency (ATT) consent. See our Privacy Policy for details.
The App, including its software, design, graphics, text, and trademarks, is owned by us or our licensors and is protected by intellectual-property laws. Except for the license above, no rights are granted to you.
We may update, change, or discontinue the App (or any feature) at any time. Your license ends automatically if you breach these Terms. You may stop using the App at any time by deleting it.
The App is provided “AS IS” and “AS AVAILABLE”, without warranties of any kind, whether express or implied, including fitness for a particular purpose, accuracy, or uninterrupted or error-free operation, to the maximum extent permitted by law.
To the maximum extent permitted by law, we will not be liable for any indirect, incidental, special, consequential, or punitive damages, or for any loss of data, arising from your use of the App. Nothing in these Terms limits liability that cannot be limited under applicable law.
If you obtained the App from the Apple App Store, the following applies: these Terms are between you and us only, not Apple; Apple has no obligation to provide maintenance or support for the App; Apple is not responsible for any product warranties or claims relating to the App; and Apple and its subsidiaries are third-party beneficiaries of these Terms and may enforce them against you. You confirm you are not located in a country subject to a U.S. Government embargo and are not on any U.S. Government restricted-parties list.
These Terms are intended to operate alongside the mandatory consumer-protection laws that apply in your place of residence, and nothing here removes rights you have under those laws.
We may revise these Terms from time to time. When we do, we will update the “Effective” date below. Continued use of the App after a change means you accept the revised Terms.
